1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Finaps is a personal finance platform that helps you track expenses, manage budgets, set savings goals, monitor net worth, and gain AI-powered insights into your spending habits. The Service is available on iOS, Android, and the web.

Features include manual transaction entry, receipt scanning via OCR, voice input, bank account syncing (via Plaid in supported regions), multi-currency support, recurring transaction management, financial reports, and a natural language AI assistant. Feature availability may vary by subscription tier and region.

3. Account Registration

To use the Service, you must create an account with a valid email address and verify it via a one-time passcode (OTP). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information during registration and to keep your account information up to date. You must notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Subscription & Billing

Free Tier

The Free tier provides access to core features with certain limits (e.g., 50 transactions per month, 3 custom budgets, 2 accounts). The Free tier is available at no cost and does not require a payment method.

Pro Subscription

The Pro subscription ($5.99/month or $59.99/year) unlocks all features including unlimited transactions, AI-powered insights, receipt scanning, voice input, bank sync, and advanced reporting. New accounts receive a 14-day free trial of Pro.

Payment & Cancellation

Web subscriptions are processed through Stripe. Mobile subscriptions are managed through the Apple App Store or Google Play Store via RevenueCat. All subscriptions auto-renew unless canceled before the end of the current billing period.

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain Pro access until the end of the current billing period, after which your account reverts to the Free tier. No refunds are provided for partial billing periods, except where required by applicable law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for money laundering, fraud, or any illegal financial activity.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated scripts, bots, or scrapers to access the Service without our written permission.
• Upload malicious content, viruses, or any material that could harm the Service or other users.
• Abuse the AI features by submitting content designed to extract system prompts, generate harmful content, or circumvent usage limits.

6. Intellectual Property

The Service, including its design, code, logos, trademarks, and all content created by Finaps, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written consent.

You own your data. All financial data, transactions, and personal information you enter into Finaps remains yours. We do not claim ownership of your content. You grant us a limited license to process your data solely for the purpose of providing and improving the Service. You may export or delete your data at any time.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. The

AI-generated insights, predictions, and recommendations are provided for informational purposes only and should not be relied upon as professional financial advice. AI models may produce inaccurate or incomplete results. You should always consult with a qualified financial professional before making significant financial decisions.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the accuracy of data provided by third-party services such as Plaid or exchange rate providers.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Finaps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).

10. Termination

You may terminate your account at any time by deleting it from your account settings. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion. If we terminate your account for a reason other than a Terms violation, we will provide a pro-rated refund for any unused portion of a prepaid subscription.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice via email and/or a prominent in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction. Class action lawsuits and class-wide arbitrations are not permitted.
